The European Commission (EU) has opened a formal investigation into the legality of Microsoft's investment in OpenAI. "We are checking whether Microsoft's investment in OpenAI is subject to review under EU merger rules," the EU said today in a call for comments on the state of competition in virtual worlds and creative artificial intelligence (AI). The announcement marks the second formal expression of interest in Microsoft's investment in OpenAI, a maker of creative AI models. In December 2023, the UK government announced a similar investigation shortly after Microsoft received a non-voting seat on OpenAI's board in a settlement that led to co-founder Sam Altman's return as CEO. To date, Microsoft has invested a total of $13 billion in San Francisco-based OpenAI in three phases that began in 2019. With that investment, Microsoft has integrated OpenAI's model into its own products, including the Bing search engine and the Office suite of programs. Microsoft Azure is OpenAI's single cloud service provider. U.S. competition authorities also reportedly opened a preliminary investigation into the relationship between the two companies in December 2023, citing officials.
