The U.S. Court of Appeals in Manhattan sided with the SEC in a case involving Tesla CEO Elon Musk's appeal of a 2018 settlement with the U.S. Securities and Exchange Commission (SEC). Musk had sought to dismiss a settlement with the SEC that required him to "refrain from tweeting about Tesla's business and other matters affecting its stock price without prior approval from the company's legal team. He lost the case at first instance and then on appeal. In August 2018, Musk tweeted, "Considering taking Tesla private at $420/share. Funding is in place," he tweeted in August 2018.
