Samsung Electronics has been granted an interim licence by the High Court in London to use ZTE’s mobile phone patents. This ruling comes from the UK litigation in the ongoing global patent licensing dispute between the two companies. While UK courts have recently allowed short-term patent licences pending trial, this is the first time a court of first instance has officially declared such an interim licence. Both Samsung and ZTE submitted competing proposals for the interim licence, but the court found that ZTE had acted in bad faith by filing unnecessary injunctions. With this decision, Samsung can use ZTE’s patents until FRAND (fair, reasonable, and non-discriminatory) terms are determined. Meanwhile, ZTE is also pursuing parallel lawsuits against Samsung in China, Germany, and Brazil.
삼성전자가 영국 런던 고등법원에서 ZTE의 휴대폰 특허를 임시로 사용할 수 있는 라이선스를 인정받았다. 이번 판결은 양사가 전 세계적으로 벌이고 있는 특허 라이선스 분쟁의 영국 내 소송에서 나왔다. 영국 법원은 최근 재판 전까지 단기 특허 라이선스를 허용하는 판결을 내린 바 있으나, 1심 법원이 임시 사용권을 공식 선언한 것은 이번이 처음이다. 삼성과 ZTE는 각각 임시 라이선스 조건을 제시했으나, 법원은 ZTE가 불필요한 가처분 소송을 남발하며 악의적으로 행동했다고 판단했다. 이번 판결로 삼성은 FRAND(공정·합리·비차별) 조건이 결정될 때까지 ZTE 특허를 사용할 수 있게 됐다. 한편, ZTE는 중국, 독일, 브라질 등에서도 삼성을 상대로 병행 소송을 진행 중이다.
