Europe's top court ruled against Apple on Tuesday in its 10-year legal battle over tax issues in Ireland. The case dates back to 2016 when the European Commission ordered Ireland to collect up to 13 billion euros ($14.4 billion) in back taxes from Apple. The decision comes just hours after Apple unveiled new products, including updates to its iPhone, Apple Watch, and AirPods.
Apple has stated that it will incur a one-time income tax charge of around $10 billion in its fourth fiscal quarter. The Irish government noted that the case is of “historical relevance” and reiterated that it does not provide preferential tax treatment. Apple maintains that this case is not about how much tax it owes, but which government it is required to pay.
The European Court of Justice (ECJ) has upheld the European Commission’s original 2016 ruling, overturning a previous General Court decision. This case underscores the ongoing tension between U.S. tech giants and the European Union, which continues to address issues like data protection, taxation, and antitrust. Apple is also facing additional EU antitrust penalties and regulatory investigations under the Digital Markets Act.
