The Writers Guild of America secured significant AI guardrails in its 2023 contract with major studios after a 148-day strike, but writers now claim they need additional protection and are urging entertainment companies to take legal action against AI firms allegedly using writers' work without permission to train AI models. "Leverage" co-creator John Rogers discovered that ChatGPT could suggest episode plots using his show's characters without prompting, and later found that scripts from his shows were included in a database used to train AI models through subtitles from OpenSubtitles.org. In December, the WGA sent a letter to leaders at major studios including Netflix, Amazon MGM Studios, and Sony Pictures Entertainment urging them to take legal action, but so far no major studio has filed a lawsuit against any AI company despite writers' complaints.

The tech industry argues that training AI models with content available online falls under the "fair use" doctrine, though there remains significant debate about what constitutes "publicly available" material and how it becomes accessible to AI models. The current WGA-AMPTP contract ensures a human writer is behind every script and requires notification if AI-generated material is provided to writers, but does not address compensation when writers' work is used to train AI models. AI companies are currently facing several copyright lawsuits from publishers like the New York Times and music giants such as Universal Music Group, with a recent ruling in favor of Thomson Reuters against AI startup Ross Intelligence potentially setting precedent. Writers like John Lopez, who has worked on series including "The Terminal List," express concerns that AI technology devalues the artistry of screenwriting and will make it harder for up-and-coming writers to break into the industry.
